Ticketing Services Agreement
Our Services and Responsibilities
Daisy Tickets will accept and process online orders for Tickets to your Event and process card payments to the Event on your behalf and provide a report for each Ticket sold and the funds processed by us.
Fees, Charges and Payment
Daisy Tickets charges a per Ticket booking (or service) fee and any applicable delivery fee to the Ticket Purchaser and those fees are retained by Daisy Tickets and deducted from your booking revenue. We usually submit payment for one hundred percent (100%) of the total balance due to you within five business days of the Event being held and concluded as advertised, however, we reserve the right to withhold funds at any time that we determine to be necessary for the processing and settlement of all returns, disputed charges and any other discrepancies for up to thirty days (30) from the conclusion of the Event. All sales, fees, charges and funds are payable to your nominated Australian Bank Account and is paid in Australian Dollars.
Cancellations, Credits and Chargeback's
It is Daisy Tickets responsibility to issue refunds to the Ticket Purchaser. If the Event is cancelled for any reason, a complete refund must be issued to every Ticket Purchaser. Daisy Tickets will handle all refunds for cancelled or rescheduled Events. All fees charged to every Ticket Purchaser must be refunded including any booking, service or delivery fees. No payments shall be made to you due to an Event cancellation. You will receive a Tax Invoice for any booking, service or delivery fees we have incurred. If an Event is rescheduled for a different date and a Ticket Purchaser cannot attend the new date, the Ticket Purchaser will receive a full refund. You will receive a Tax Invoice for any booking, service or delivery fees we have incurred. Any card chargeback initiated by the Ticket Purchaser for any reason, with the exception of fraudulent use of the card, shall be charged back to you. Daisy Tickets shall either (i) deduct these costs from your outstanding balance, whether for that particular Event or for any other Event that you list with us; or (ii) we will send a Tax Invoice for the costs if no balance exists. If payment for the Tax Invoice is not made by the due date, we reserve the right, at our sole discretion, to terminate this Ticketing Services Agreement and to cancel all other Events listed by you.
Posted and Venue Pickup (Will Call) Tickets
We will deduct the total of any card chargeback Daisy Tickets receives for Tickets not delivered by post to the Ticket Purchaser or given to the wrong person at a Venue pickup.
Event Restrictions
It is your responsibility to provide to Daisy Tickets any Event restrictions. Any Event that requires a restriction for admission must be clearly stated by you. It is your responsibility to ensure that any restriction is lawful and does not violate any Federal, State, Territory or Local government laws prior to submitting the Event to us. It is also your responsibility to verify that a Ticket Purchaser can be admitted to your Event.
Misrepresentation of Event
The Event must be accurately and truthfully described in writing to Daisy Tickets. If we discover and determine, in our sole discretion, that you misrepresented the Event, we will cancel the Event listing and a refund shall be issued to the Ticket Purchaser pursuant to Cancellations, Credits & Chargeback's above. If we determine that you repeatedly misrepresent an Event, your account will be terminated and any other Events submitted by you will be cancelled pursuant to Cancellations, Credits & Chargeback's above.
Termination
Except as provided elsewhere in this Ticket Services Agreement, either party may terminate this Ticket Services Agreement at any time with written notice to the other. If you terminate this Ticket Services Agreement after you have submitted your Event to us, your Event shall be cancelled pursuant to Cancellations, Credits & Chargeback's above.
Force Majeure
If the performance of any part of this Ticketing Services Agreement as described herein is prevented, hindered, delayed or otherwise made impracticable by reason of any flood, riot, fire, judicial or governmental action, labour disputes, act of God or any other causes beyond the control of Daisy Tickets, we shall be excused to the extent that it is prevented, hindered, or delayed by such causes.
Indemnity
You agree to be fully responsible for and fully indemnify us against all claims, liability, damages, losses, costs and expenses, including legal fees suffered by us and arising out of any breach of the Ticketing Services Agreement as described herein by you.
